Can I remove a sex crime conviction from my permanent record?

A criminal record can affect your ability to get a job, secure housing, adopt a child, or do any number of things in the future. The good news is that NJ law may provide you with an opportunity to essentially “remove” the conviction from your record through a process known as expungement. However, there are many restrictions on your ability to expunge a sex crime conviction from your permanent record. While disorderly persons offenses can be expunged relatively easily, a person convicted of an indictable felony must wait at least five years before petitioning for an expungement. Moreover, certain serious sex offenses, such as aggravated sexual assault, aggravated criminal sexual contact, and endangering the welfare of a child by engaging in sexual conduct, are ineligible for expungement.

Keep in mind that even if you cannot expunge your sex crime conviction, you may still be able to petition for removal from Megan’s Law sex offender registration requirements in NJ. Depending on the circumstances of your case and conviction, it might be possible to file for an appeal to either reclassify your Megan’s Law status or to get you removed entirely.
