What Constitutes “Sexual Assault” in the State of New Jersey?

Sexual assault refers broadly to any sexual encounter in which one person does not offer consent. The use of physical force or coercion against a rape victim is considered sexual assault. These charges are addressed by N.J.S.A. 2C:14-2. A sexual assault charge can be brought in a number of situations, including:

  • When an individual is accused of sexual contact with a person under the age of 13
  • When a person is accused of committing an act of sexual penetration with a victim between the ages of 13 and 16
  • When the offender was related to the victim or was in a position of control over the victim and the victim was between the ages of 16 and 18

Sexual assault offenses are classified as second degree felonies. This means that an offender is subject to a term of incarceration of between five and 10 years in NJ State Prison. Additionally, if you are accused of using a weapon during the commission of a sexual assault in New Jersey, you may face enhanced penalties. Beyond that, sexual assault charges are often accompanied by kidnapping charges, which can lead to more severe penalties.
