Atlantic City, New Jersey Lawyer Defends Clients Charged with Driving Without Insurance

When it comes to carrying motor vehicle insurance in New Jersey, the laws are very clear. If you get stopped while driving a car that does not have the correct amount and type of insurance coverage, you will likely be facing serious charges. Penalties associated with Driving Without Insurance in New Jersey include significant fines, points, possible license suspension, and depending on your driving record, jail time.

NJ’s Compulsory Motor Vehicle Insurance Law (N.J.S.A. 39:6B-1) requires drivers to carry a minimum amount of liability insurance. If you or someone you know has been charged with failing to obey the insurance law, you need a skilled motor vehicle violations lawyer in Atlantic and Cape May counties who will fight your charges. Contact the Law Offices of John W. Tumelty for a free consultation today. He has been defending clients charged with criminal and [nl_link id=’342′]traffic violations[/nl_link] for over 35 years. What are the Penalties for Driving Without Insurance?

For a first-time violation of the driving without liability insurance law, you may face a fine of between $300 and $1,000, community service, an annual Division of Motor Vehicles surcharge of $250 for three years (or $750) and mandatory license suspension for one year.

If you get a second ticket for failing to carry the required amount of insurance, you may be looking at a fine up to $5,000, mandatory jail time (two weeks!) and 30 days of community service. Further, you’ll lose your driving privileges in New Jersey for two full years.

Be aware, police in Atlantic and Cape May counties are vigilant when it comes to drivers who disobey traffic rules. If you get stopped driving without insurance on the Atlantic City Expressway, Garden State Parkway, or routes 9,40, 30, 206, you need to call a lawyer who can assist in your defense. Defenses to Driving Without Insurance in New Jersey

John W. Tumelty is a former state prosecutor and longtime criminal defense lawyer in Atlantic, Cape May and Ocean counties in New Jersey. He knows how serious the State takes traffic violations such as driving without insurance, driving with a suspended or revoked license, [nl_link id=’344′]reckless driving[/nl_link] and DUI/DWI. His experience has taught him that there are several potentially successful defenses to these charges.

  • The car is registered in another state (or is kept most of the time in another state) and therefore may not be subject to New Jersey insurance guidelines.
  • You borrowed the car and didn’t know the car was not insured properly.
  • You don’t own the uninsured car you were driving but you are a covered driver on another insurance policy. (Proving you understand and have followed the laws.)
  • You failed to make a payment on your insurance policy and, subsequently, coverage lapsed. Mr. Tumelty may be able to explain your mistake to the prosecutor and get your charges reduced or dismissed, especially if you show proof of insurance at the time of your court hearing.
  • Your insurance company illegally cancelled your policy and you were not aware of it.

While there are no guarantees, Mr. Tumelty has had considerable success with these defense strategies. He will work tirelessly to get your charges dismissed or reduced. Contact his offices in Atlantic City, Marmora or Somers Point, NJ for a free consultation about your charges.
