Why Choose a Former Prosecutor to Handle Your Criminal Defense?

Experience is an obvious prerequisite for choosing an attorney when you’re facing serious criminal charges. You want to know that your lawyer is comfortable and has a successful track record trying your kind of case. However, there may be another type of experience that you haven’t considered: prosecutorial experience. It’s not uncommon for former prosecutors to become criminal defense attorneys later on in their careers. If you find that you have the opportunity to consult with one of these lawyers, it may be in your best interest to do so. Former prosecutors often make the most effective criminal defense attorneys for a number of reasons, including:

Unique Knowledge and Perspective

Experience on both sides of the proverbial table can give your lawyer unique insight and a competitive advantage in your case. It helps the defense lawyer to better understand the trial process and the methods of gathering evidence employed by the prosecuting attorney. A former prosecutor is also in a better position to assess the strength of the case against you and advise whether it’s a good idea to push for a plea or bring the case to trial. They can also provide an unspoken psychological advantage in the courtroom, giving you an extra edge when you need it most.

Understanding the Nuances of Prosecutorial Strategy

A former prosecutor may also be better positioned to negotiate on your behalf. They may have a better understanding of the temperament and mindset of the prosecuting attorney, particularly if they have worked with them in the past. This could make all the difference when you’re facing serious criminal charges and the case isn’t exactly going your way in court. Finally, there’s the passion factor. If a former prosecutor defends you with the same zeal and passion with which they tried their prosecution cases, you are sure to have an effective and committed legal advocate on your side.
