Underage Gambling in Atlantic City is a Bad Bet

People flock from all over the world to New Jersey to take their shot at getting lucky in Atlantic City. Locals are drawn, as well, to the nightlife and people watching. There are countless shows and attractions that are mere minutes away.

It stands to reason that Atlantic City’s allure is just as attractive for people who are not legally permitted to drink or gamble. Whether it’s the idea of possibly making a quick buck at a slot machine, getting a free drink from a lounge waitress or just enjoying the atmosphere, one thing is for certain. If you are not yet 21 years of age, stay off the casino floors.

Security personnel at every casino in Atlantic City are required to always check ID. If they suspect you of being underage and ask for ID, you better be able to produce a legitimate ID card. Failure to do so will cost you more than even the longest shot bet. By law (and in order to protect their own jobs) the security guards must report you to the police.

Make no mistake about it, the penalties associated with underage gambling are severe in New Jersey. And, remember, you don’t have to be sitting at a Blackjack table to be charged. Merely your presence on the casino floor is enough to trigger charges.

N.J.S.A. 5:12-119 is New Jersey Casino Control Act which says underage gambling will be treated like a disorderly persons offense. Consequences for conviction include:

  • Fines of being $500 and $1,000
  • Driver’s License Suspension for six months
  • Community Service
  • Probation
  • Jail Time, depending on the situation and judge’s discretion
  • A criminal record

There are ways to defend these charges. However, since Atlantic City prosecutors won’t plea bargain these types of charges (they are considered strict liability offenses), you need to hire an experienced and knowledgeable criminal defense lawyer to fight your child’s underage gambling charges.
