John W. Tumelty, founding partner of the Law Offices of John W. Tumelty, is a former New Jersey Deputy Attorney General and a former Atlantic County Assistant Prosecutor. He now handles criminal and DWI cases throughout Atlantic County and Cape May County, where he has earned the respect of local prosecutors and judges. His credentials as a criminal and DWI defense attorney are impeccable. Mr. Tumelty is a New Jersey Supreme Court certified criminal trial attorney, a distinction earned by less than two percent of all attorneys in the state.

What is the Alcotest?

All police departments in New Jersey use the Alcotest machine in DUI cases. Unlike the old breathalyzer, the Alcotest machine relies on two different techniques to measure the concentration of alcohol: infrared absorption and electrochemical reaction. A breath sample from a suspected drunk driver is forced into a breath sample chamber, and the machine calculates the blood alcohol concentration utilizing both methods.

Mr. Tumelty is very well- experienced with the Alcotest machine and foundation documents that go with it. The Alcotest documents include the inspection and calibration records for the machine, the simulator solution records, and updated certification of the operator. If the state cannot prove that the Alcotest machine was properly maintained, inspected, and calibrated, he may be able to get the breath test readings in your case thrown out.
